SUBJECT TO THE FOLLOWING TERMS. DECLARATION. I ,the "USER" WOULD LIKE TO
RECEIVE MP3's AND OR DATA FILES OF THE MUSIC YOU ARE PROMOTING. I HEREBY
DECLARE THAT I WILL NOT FILE SWAP/SHARE THIS MUSIC WITH ANYBODY ELSE'S
COMPUTER VIA THE INTERNET OR COPY THE MUSIC FOR OTHERS. I UNDERSTAND
THAT IF I AM CAUGHT DOING SO MY NAME AND PERSONAL DETAILS WILL BE GIVEN
TO OTHER RECORD LABELS, TO BE REMOVED FROM THEIR MAILING LISTS AND I
WILL BE REPORTED TO MIPI (Music Industry Piracy Investigations) AND ARIA
(Australian Recording Industry Association). References to "we",
"us" or "our" "GLOBAL" are to GLOBAL PR POOL.
References to "user" "you", "your" are to Djs, who name and addresses
are registered with
www.globalprpool.com
1. The Agreement between "us" and the
"user"
1.1 Your use of the sign-up website (the "Site") and the
sign-up data processing services (together, the "Services ") are subject
to you accepting the following Terms and Conditions of Use and Privacy
Policy (together, the "Terms of Use").
1.2 Your acceptance of the
Terms of Use shall be indicated by you clicking on the "Accept" box at
the bottom of this document and your continued use of the Services. If
you do not accept all the Terms of Use, you must click the "Decline" box
at the bottom of this document and you must not continue to register to
use the Services.
1.3 Any error or omission of any information that
we publish about the Services shall be subject to correction, provided
that the correction does not materially affect the Services.
1.4 We
may change or add to these Terms of Use for security, legal or
regulatory reasons. We will inform you of any changes that we intend to
make by posting a notice of the Site.
1.5 If you do not wish to
accept any amended Terms of Use you should close your membership account
as instructed on the Site or by contacting us and stop using the
Services immediately. If you do not close your membership account, your
continued use of the Services will signify your acceptance of any
amended Terms of Use.
2. Registration and using the Services
2.1 In order to use the
Services you will need to create your personal sign-up membership
account on the Site by selecting a username and password and entering
certain personal details which we will use in accordance with our
Privacy Policy.
2.2 You agree that you will register in your own
name only and all information provided by you will be accurate and
up-to-date. You agree to promptly update any of your details on the Site
as necessary.
2.3 You may not transfer your membership to another
person.
2.4 You are responsible for maintaining the confidentiality
of your password and for all use of the Services made through your
password. You agree to keep your password secret at all times and must
inform us, and promptly change your password, if you believe that
another person has become aware of your p assword or is using it or is
likely to use it in an unauthorised way.
3. Intellectual Property
3.1 All information, data and materials
used in the Services (including materials accessible on the Site and the
software used to access the Services) are protected by rights, including
copyright, design rights, database rights and trade marks. All these
rights are either owned by us or licensed to us by the rights owner(s)
for use with the Services or otherwise used by us as permitted by
applicable law.
3.2 The Services are intended for individual,
personal use only. Accordingly, you may print and download extracts from
this Site for your own personal, non-commercial use, provided that any

you, will become the property of GLOBAL PR POOL, to be used freely as we
see fit.

particular, you agree not to:

access or transmit material that is obscene, sexually explicit,
defamatory, threatening, degrading, racist, in breach of confidence or

copyright) or otherwise objectionable or unlawful;
(b) use the
Services to knowingly or recklessly transmit material (including
viruses) or otherwise use the Services so as to cause harm to the
Services or other users or which is likely to bring the Services or
Global into disrepute; or
(c) use the Services to gain unauthorised
access to other computer systems or interfere with services to other
host providers, networks or websites.
(d) avoid authentication
processes or security of the Services or interfere with the use of the
Services by other members;
(e) access or attempt to access parts of
the Services that you are not authorised to access or collect or store
other members' usernames, passwords or personal data;
(f) reverse
engineer or decompile (whether whole or in part) any software used in
the Services;
(g) impersonate any person, or entity or misrepresent
your affiliation with anyone or entity;
(h) intentionally violate
any other applicable law or regulation while using the Services.
5. Limits to your rights
5.1 The internet is not a secure
environment and we cannot guarantee that the Site and the server are
free of computer viruses or other harmful applications. We recommend
that you regularly update your browser software and use up-to-date
anti-virus software to ensure that your access to the Services is as
secure as possible. 5.2 This website may contain links to third
party websites. These links are provided solely for your convenience. If
you use these links, you leave this website. We do not control and are
not responsible for these websites or their content or availability. We
therefore do not endorse or make any representations about them, or any

shall have no liability for lost, damaged, or destroyed Downloads.
5.4 In so far as is possible in law, we exclude all liability and
responsibility for any amount or kind of loss or damage that may result

profits (whether direct or indirect), data, contracts, and whether in
tort (including without limitation negligence, contract or otherwise) in

6. Your responsibility to us
6.1 You shall be responsible for any
losses, expenses or other costs incurred by us which are caused by your
deliberate breach of these Terms of Use.
6.2 You shall prompty reply
with honest, DJ Feedback, Comments and a rating within a minimum of two
(2) weeks maximum of four (4) weeks. Failure to comply will result in a
suspension of services.
6.3 You shall be responsible for your
passwords security. You shall not give out, transfer your password to
any third parties. You are responsible for any mis-use of your password,
whether by you or any third party. Do not allow others to use your
account.
6.4 You are authorized to use the Content, Music, Files,
Material for personal use only. You are permitted to make one (1) copy
of the tracks, music, files, clips, content or materials for
personal use only and in order to promote the release title. You cannot
make copies of the Clips, Tracks, Files, Music or Materials or other
Content to give, sell, resell, reproduce, loan, broadcast, send or
transmit to friends, family, third parties or anyone else. To carry out
any of these forbidden acts would be a breach of The Copyright Act
(1968).
6.5 It is illegal to file share. You may not upload Content,
Music, Tracks, Files and alike derived from the site
www.globalprpool.com to the
internet. Peer-2-peer file sharing is strictly prohibited. Any other
manner of network file sharing, distribution and transfer of Content,
Music, Tracks and Files and alike to devices or peer-2-peer networks,
blogs, one-click file hosts, third party websites and alike for such
purpose is prohibited. If Global finds Clips, Tracks, Files, Music or
Content and alike derived from
www.globalprpool.com that you have offered, distributed,
transmitted or sold on peer-2-peer networks, blogs, one-click file
hosts, third party websites and alike we reserve the right to pass your
details on to the record label who hold the copyright, MIPI (Music
Industry Piracy Investigations) AND ARIA (Australian Recording Industry
Association).
6.6 You may not sell, resell, reproduce, broadcast the
Tracks, Clips, Files, Music, Content and/or Material to any third party.
7. Terminations and Suspension
7.1 We may cancel or suspend your
membership account and/or suspend your access to the Services if:
(a) you breach these Terms of Use or misuse the Services provided by us;
or
(b) become errant in your provision of DJ feedback, comments and
overall rating of each downloaded track.
(c) you have behaved in a
way which objectively could be regarded as inappropriate or is unlawful
or illegal or which would bring us and/or the Sign-up brand into
disrepute.
7.2 We may suspend access to the Services or require you
to change your password if we reasonably believe that the Services have
been or are likely to be misused, and we will notify you accordingly.
7.3 It may be necessary, for reasons beyond our control, to
terminate the Services and if this occurs we will endeavour to provide
as much notice as is reasonably possible in the circumstances.
7.4
We may terminate the Services and this agreement between us at any given
time at our discretion.
8. Privacy Policy
8.1 Any personal in formation that we collect
from you will only be used by us in accordance with our privacy policy,
which forms part of these Terms of Use.
8.2 You hereby give consent
to communication with you by E-Mail, phone and /or SMS and the
personal information that you have provided.
8.3 Any comments,
ratings and chart positions entered by you, will become the property of
GLOBAL PR POOL, to be used freely as we see fit.
9. Disputes and law
9.1 This agreement shall be deemed to have
been made in the State of Victoria , Australia , and it shall be
governed by the laws of the said State and the parties agree to submit
all disputes to the jurisdiction of the courts of Victoria Australia.
